We keep your personal information personal and private. We will not sell, rent, share, or otherwise disclose your personal information to anyone except as necessary to provide our services or as otherwise described in this Policy without first providing you with notice and the opportunity to consent.
- Subscribers are our direct clients. Subscribers are the companies that directly contract for Intermodal Portal Services with us.
- Customers are our Subscribers’ direct clients, vendors, agents, consultants or anyone provided access to the Intermodal Portal by Subscriber.
This Policy does not apply to our Subscribers’ websites, which may have their own terms and privacy policies. Our Subscribers are solely responsible for establishing policies for and ensuring compliance with all applicable laws and regulations, including those relating to the collection of personal information in connection with the use of our services.
XSolutions’ Websites and Services are not intended for, nor designed to attract, individuals under the age of eighteen. XSolutions does not knowingly collect personally identifiable information from any person under the age of eighteen.
Legal Basis for Processing (EEA only):
If you are an individual from the European Economic Area (EEA), please note that our legal basis for collecting and using your personal information will depend on the personal information collected and the specific context in which we collect it. We normally will collect personal information from you only where: (a) we have your consent to do so, (b) where we need your personal information to perform a contract with you (e.g. to deliver the Services you have requested), or (c) where the processing is in our legitimate interests. Please note that in most cases, if you do not provide the requested information, we will not be able to provide the requested service to you.
In some cases, we may also have a legal obligation to collect personal information from you or may otherwise need the personal information to protect your vital interests or those of another person.
Where we rely on your consent to process your personal data, you have the right to withdraw or decline consent at any time. Where we rely on our legitimate interests to process your personal data, you have the right to object.

XSolutions Collects Your Personal Information
The Intermodal Portal Application is a Software-as-a-Service (“SaaS”) application that uses information on Subscribers’ databases for the purpose of providing detailed reports and analysis from which Subscribers and their Customers can make business decisions.
The Service involves the storage of Data about a company, Subscriber or Customer. That Data can include personal information. “Personal information” is information about an identifiable individual, and may include information such as the individual’s name, Company, email address, telephone number, and IP Addresses.
We may collect personal information directly from You when You:
- Register to use the Service
- Use the Service,
- Post to any of our Sites
- Contact our support team
- Visit our Site
You can always choose not to provide Your personal information to us, but it may mean that we are unable to provide You with the Service.
By using the Service, you consent to your personal information being collected, held and used in this way and for any other use you authorize. We will only use your personal information for the purposes described in this Policy or with your express permission.
It is your responsibility to keep your password to the Service safe. You should notify us as soon as possible if you become aware of any misuse of your password, and immediately change your password within the Service or via the “Forgotten Password” process.
How We Use Your Information
XSolutions only processes personal information in a way that is compatible with and relevant for the purpose for which it was collected or authorized. As a general matter, for all categories of data we collect we may use the information we collect (including personal information, to the extent applicable) to:
- Verify your identity;
- Communicate with you;
- Provide, operate, maintain, improve, and promote the Site and Services;
- Enable you to access and use the Site and Services;
- Resolve service and billing disputes;
- Troubleshoot problems;
- Bill any amounts due from you;
- Measure user interest in our products and services, inform you about online and offline offers, products, services, events and updates; deliver information to you that, in some cases, is relevant to your interests, such as product news; customize your experience;
- Personalize the Site and Services, including by providing features or content that match your interests and preferences;
- Detect and protect us against error, fraud and other criminal activity;
- Provide you with system or administrative messages, and as otherwise described to you at the time of collection;
- On occasion we use email addresses or other contact information to contact Users to ask for their input on our services;
- Comply with laws and regulations in applicable jurisdictions;
- Process for other purposes for which we obtain your consent.
What Information Do We Collect?
Our primary purpose in collecting personal information from you is to provide you with a safe, smooth, efficient, and customized experience. This allows us to provide services and features that most likely meet your needs, and to customize our service to make your experience safer and easier. We only collect personal information about you that we consider necessary for achieving this purpose.
As a User, we require you to provide accurate contact and identity information, billing information, and other personal information.
In addition, as you use the Site, you can from time to time enter or send to us personal information. For example, if you are a Subscriber, you can enter billing information, and if you are a Customer you can enter information required by a Subscriber. As you use the Site you can also from time to time enter personal information about third parties. For example, if you are a Subscriber, you can enter personal information about your Customers.
You always have the option to not provide information by choosing not to become a User or by not using the particular feature of the Site for which the information is being collected.
If you are a Subscriber, we may collect your credit card information for billing purposes.
We also automatically track certain information about you based upon your behavior on our Site. We use this information to do internal research on our users’ demographics, interests, and behavior to better understand, protect and serve you and our community. This information is accessible to a User’s direct Subscriber. This information may include log data, the URL that you just came from (whether this URL is on our Site or not), which URL you next go to (whether this URL is on our Site or not), your computer browser information, and your IP address.
Information from Third Party Services. We may combine information we collect as described above with personal information we obtain from third parties. For example, we may combine information entered on an XSolutions’ submission form with information we receive from a third-party sales intelligence platform vendor to enhance our ability to market our Services to Subscribers, Customers and Users.
In providing the Service, we utilize “cookies”. A cookie is a small text file that is stored on your computer for record-keeping purposes. A cookie does not identify you personally or contain any other information about you but it does identify your computer.
We and some of our affiliates and third-party service providers may use a combination of “persistent cookies” (cookies that remain on your hard drive for an extended period of time) and “session ID cookies” (cookies that expire when you close your browser) on the Site to, for example, track overall site usage, and track and report on your use and interaction with the Service.
You can set your browser to notify you when you receive a cookie so that you will have an opportunity to either accept or reject it in each instance. However, you should note that refusing cookies may have a negative impact on the functionality and usability of the Site.
We do not respond to or honor “Do Not Track” requests at this time.
You Can Opt-out Of Email Communications
XSolutions sends billing information, product information, Service updates and Service notifications to you via email as appropriate to the type of visitor you are (please refer to explanation at the beginning of this document). You can choose to be removed from any mailing list not essential to the Service. We will remove you at Your request.
Our Disclosure of Your Information
We will share your personal information with third parties only in the ways that are described in this privacy statement. We do not sell your personal information to third parties. The following describes some of the ways that your information may be disclosed in the normal scope of business to provide our services:
Subscribers and Customers, etc. In the normal operation of the Site, Subscriber information (including information entered by “staff” members) and invoices are disclosed to the applicable parties. In general, information you enter on the Site is available to the other persons – whether they are Customers, Subscribers, staff members or others – to whom you give access to your account or to whom you give access to the information through the normal operation of the Site We may also disclose information as you may otherwise consent from time to time.
Payment Information. We do not store credit card or other payment method information on any internal online system. However, we will enter applicable payment information into our financial institution’s systems (such as Authorize.net) so they can process credit card payments (either one time charges or automatic reoccurring payments). We use PCI Compliant providers, such as Authorize.net.
Anonymized Aggregated Data. We may aggregate and anonymize sales usage information and disclose such information in a non-personally identifiable manner. However, in these situations, we do not disclose any information that could be used to identify you personally.
Subsidiaries and Affiliates; Service Providers. We may from time to time use the services of affiliates, subsidiaries, program developers, and unrelated service providers in the operation of the Site and may disclose personal information to them in the course of our use of their services. For example, we may use the services of third-party hosting companies to host the operation of the Site. This may involve the hosting of data, including personal information, on servers operated by those hosting companies. We take care to use only service providers that we believe are reputable and able to live up to our and your expectations, including the handling of confidential information.
Specifically, we do not permit our Service Providers to use any personal information we share with them for their own marketing purposes or for any other purpose than in connection with the services they provide to us.
Legal Requests; Emergencies. XSolutions may disclose your personal information (a) to any governmental authority as part of an investigation to determine our compliance with any applicable law, rule, or regulation (including privacy laws, rules, and regulations), (b) in response to a court order, subpoena, discovery request, or other lawful judicial or administrative proceeding, (c) as otherwise required under any applicable law, rule, or regulation, and (d) in good faith, to protect or defend the rights or property of XSolutions and other users.
We do not sell, rent, or share personal information with third parties for their direct marketing purposes.
International Information Transfers
XSolutions is a U.S.-based company and since the Intermodal Portal is a Software-as-a-Service (“SaaS”) application, its services may be accessed globally. The Intermodal Portal uses Microsoft Azure. Currently, data is stored on servers in the United States. If you are located outside of the United States, please be aware that Personal Data we collect will be processed and stored in the United States, a jurisdiction in which the data protection and privacy laws may not offer the same level of protection as those in the country where you reside or are a citizen.
By using our Services and/or submitting your Personal Data, you agree to the transfer, storage, and/or processing of your Personal Data in the United States.
If you are accessing or using our Site or Services or otherwise providing information to us, you are also agreeing to the transfer of your personal information to the United States and other jurisdictions in which we operate or in which this SaaS application can be accessed.
Your Use of Other Persons’ Information
XSolutions strives to protect your personal information. For security of transactions, we use the Secure Sockets Layer (SSL) protocol, which encrypts any information that you send to us electronically. The encryption process protects your information, by scrambling it before it is sent to us from your computer. Once XSolutions receives your transmission, we make commercially reasonable efforts to ensure its security on our system. Unfortunately, no data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect your personal information, we cannot warrant the security of any information you transmit to us.
Transmission of personal information over the Internet is at your own risk and you should only enter, or instruct the entering of, personal information to the Service within a secure environment.
Other Information Collectors
Correcting and Updating Your Personal Information
It is Your responsibility to ensure that the personal information You provide to us is accurate, complete and up-to-date.
You have the right to access, correct, update, export, or delete your personal information. You may email us at [email protected] with any such subject access requests (“SAR”), and we will respond within thirty (30) days. Customers also can access, correct, export, or update their Account Information by editing their profile within the Intermodal Portal application.
We’ll only keep your personal information for as long as we require it for the purposes of providing you with the Service. However, we may also be required to keep some of your personal information for specified periods of time, for example under certain laws and financial reporting legislation and for audit or historical reasons.
Additional Policy Information
If you click on a link to a third-party site, you will leave the Site and go to the site you selected. If you elect to use a third-party product or service in conjunction with the Services, you yourself enter into a license agreement with the third party for use of their product or service and their use of your data. Because we cannot control the activities of third parties, we cannot accept responsibility for any use of your personally identifiable information by such third parties, and we cannot guarantee that they will adhere to the same privacy practices as XSolutions. We encourage you to review the privacy statements of any other service provider from whom you request services. If you visit a third-party website that is linked to an XSolutions site, you should read that site’s privacy statement before providing any personally identifiable information.
The Intermodal Portal is a complex system that connects many users and databases. This network relies on the exchange and sharing of information between users and various systems for proper operation. The complexity and connected nature of the system requires that history exists while a Subscriber maintains an account with us.
When a customer chooses to close an account, at the Subscriber’s instructions we will remove the Customer’s identifiable information from our live systems within 60 days of notice ; any personally identifiable data will no longer be available.
Notification of Privacy Statement Changes
If we make changes to this Policy that we believe materially impact the privacy of your personal data, we will promptly provide notice of any such changes (and, where necessary, obtain consent), as well as post the updated Policy on this Site noting the effective date of any changes.
We encourage you to periodically review this page for the latest information on our privacy practices.
We may assign or transfer this Policy, as well as information covered by this Policy, in the event of a merger, sale, change in control, or reorganization of all our part of our business.
